January 17, 2013 Commission Meeting Summary

Seventeen members attended today's BCDC meeting, which was held at the MetroCenter in Oakland.

At the close of the public comment period, Chair Wasserman announced that the California Department of Fish and Wildlife would be asked to present its progress on complying with its current permit to restore Ponds 9 and 10 of the Napa-Sonoma Marshes Restoration Project at a June BCDC Commission meeting.

The Commission held a public hearing on the California Department of Fish and Wildlife's permit application for Phase III of the Napa-Sonoma Marshes Restoration Project, and on the U.S. Army Corps of Engineers' consistency determination application for the same project.  The project would restore 1,900 acres of North Bay salt ponds, the last of the former Cargill North Bay ponds to be restored.
 
Solano County withdrew its amendment to its component of the Suisun Marsh Local Protection Program.
 
Staff provided a short briefing on the process BCDC staff and the Commissioner Strategic Planning Working Group has used to develop draft Goals and Objectives that will be discussed at the January 23, 2013 Strategic Planning Public Workshop.
 
The Commission held a closed session to discuss pending litigation regarding SPRAWLDEF v. BCDC, a legal challenge to the Commission's issuance of Permit No. 3-10(M) to expand the Potrero Hills Landfill in the secondary management area of the Suisun Marsh in Solano County.  The Commission voted to appeal the November 29, 2012 Solano County Superior Court ruling.
 
The Commission postponed a possible vote to set aside the Commission's approval of Permit No. 3-10(M) to expand the Potrero Hills Landfill to comply with the Superior Court's November 29, 2012 ruling in SPRAWLDEF v. BCDC because the Landfill has appealed that ruling and the writ of mandate has been stayed.

The next Commission meeting will be held on February 7, 2013, at the Ferry Building in San Francisco.  The preliminary agenda is as follows:

  1. Possible vote(s): Permit application and consistency determination proposed by the California Department of Fish and Wildlife and the U.S. Army Corps of Engineers for Phase III of the Napa-Sonoma Marshes Restoration Program the subject of today's public hearing.
  2. County Briefing: Supervisor Dave Cortese of Santa Clara County will lead a briefing and discussion on the Santa Clara County waterfront and BCDC-related issues in that county.
  3. Panel Discussion: Commissioner Barry Nelson will lead a panel discussion on the possible impacts of the Bay Delta Conservation Plan on the Bay and BCDC policies and jurisdiction.
