January 15, 2009 Commission Meeting Summary

Nineteen members attended the meeting, which was held at the MetroCenter in Oakland.

The Commission held a public hearing and voted (18-0-0) to approve a number of revisions in seven BCDC regionwide permits and two abbreviated regionwide permits that will help make BCDC's regulatory program more effective. The Commission deferred taking action on one regionwide permit and one abbreviated regionwide permit until the staff has consulted with the National Marine Fisheries Service to formulate precise standards on the maximum allowable acoustical disturbance from pile driving. The Commission held a public hearing on an application to make improvements to the inmate confinement facilities at San Quentin State Prison in Marin County. The Commission provided guidance to the staff that will be incorporated into a recommendation on the permit application that will be voted on at BCDC's January 15, 2009 meeting. The Commission voted (15-0-0) to authorize the executive director to enter into a $25,000 with Meckel Design Consulting to manage an international design competition to generate innovative design solutions to sea level rise and authorized making up to five awards totaling no more than $50,000 to refine and expand the best ideas generated by the competition. The Commission received a briefing from the California Department of Transportation on a pilot project to restore eelgrass habitat along the Berkeley shoreline. For details, contact Rafael Montes (415/352-3670 rafaelm@bcdc.ca.gov).

The Commission received a briefing on the progress being made in implementing BCDC's strategic plan and agreed to revise a few of the objectives in the plan. For details, contact Will Travis (415/352-3653 travis@bcdc.ca.gov).

Amy Vierra has been appointed to replace Chris Potter as the alternate to Commissioner Brian Baird who represents the California Resources Agency. The Commission adopted resolutions of appreciation for Chris Potter, Jerry Hill, who is no longer eligible to serve on BCDC because he has been elected to the California State Assembly, and John Silva whose term on the Solano County Board of Supervisors has ended. On January 1, 2009, the fees for processing BCDC permit applications will change. In July 2008, the Commission approved a revised permit fee schedule to comply with a directive from the Legislature that BCDC should strive to recover 20 percent of its regulatory program costs from permit fees and to achieve an agreement the Commission reached with the regulated community to make BCDC's permit fee schedule more equitable. The California Office of Administrative Law has approved changes to BCDC's regulations to put the new fee schedule into effect. For details, contact John Bowers (415/352-3610 johnb@bcdc.ca.gov).

The Commission agreed that the executive director can participate as a speaker at an international conference on delta and coastal development in Amsterdam, Holland in February 2009. The executive director will take vacation and attend on his own time, and the conference hosts will cover his costs of attending the event.
